MLO Shift, a reseller of CRM and marketing automation software from ActiveCampaign, Inc, and a provider of online information, coaching and courses to mortgage professionals takes your privacy and the security of your information seriously.

This Privacy Policy and Terms & Conditions explains how MLO Shift collects, uses and discloses information from our clients when you use our website and other online products and services, or when you interact with us. What Personal Information Does MLO Shift Collect Online?

We collect information that you provide directly to us, including, but not limited to:

Your name
Your email address
Your phone number
Your address
Your credit card information (which we do not store)
Your team members names and their contact information
Other information that you provide

Information Collected From Our Website

Our website www.mloshift.com may contain cookies, web beacons and tracking code to monitor website traffic and user activity, as well as to help us understand usage and campaign effectiveness.

Integrations With Other Services

Part of MLO Shift’s services may provide you with assistance integrating your ActiveCampaign account with other 3rd party web services and software. We may also assist you with integrating two 3rd party services to each other.

Integration with other services is optional and not required to be an MLO Shift member or to utilize the ActiveCampaign software.

It is important that you review and understand all 3rd party service privacy policies and term & conditions. If you integrate, or get our assistance with integrating ActiveCampaign or any other online or offline service or software, you are solely responsible for understanding, abiding by and agreeing to their privacy policy, terms and conditions.

Terms of Service

MLO Shift is a provider of online information, coaching and courses for use by our members. Our services and membership are available to mortgage professionals and real estate agents located in the United States and Canada only. Please do not sign-up for MLO Shift if you are outside of these two countries.

MLO Shift is also a reseller of software for ActiveCampaign and may be an affiliate of other software companies as well, which we fully disclose when promoting them. Although we do resell other companies software, MLO Shift is not a software developer or software company.

MLO Shift makes no warranty or guarantee when it comes to the ActiveCampaign software or any other 3rd party software we may help you integrate with.

By signing up for our services, you understand and agree not to hold MLO Shift liable and/or responsible for any activities, failures, downtime, theft of information and/or other occurrences that negatively affect your information, your business or the information of the contacts inside of your account due to actions or non-action from ActiveCampaign Inc or any other any outside service provider you integrate with.

As a user of ActiveCampaign software, you agree to abide by their terms of service. You should review ActiveCampaign Inc’s privacy policy and terms of service. If you do not agree with ActiveCampaign’s privacy policy or you do not agree to ActiveCampaign’s terms & conditions, you should cancel your MLO Shift membership and ActiveCampaign account. Continuing your membership with MLO Shift and remaining a user of ActiveCampaign is an indication that you fully agree to everything outlined in this document, as well as everything in ActiveCampaign’s privacy policy and terms of service.

Members cancelling their accounts will be responsible for payment in full for the current service month. MLO Shift incurs expenses for your account and membership from other service providers which are not refundable, and therefore we’re unable to offer reimbursements, refunds or pro-rated fees.

Account MLO Setup Limits

MLO Shift is for individual MLO's or small teams. We are not a enterprise solution for large companies.

Of the 25 users that are included with your account, 5 may be used with our complete individual MLO Shift setup.

This is due to our extensive, feature-rich build-out of ActiveCampaign.

The first MLO subscription is included with your initial monthly investment. Add-on MLO's who need their own pipelines, automations, etc, are available for $50/mo/MLO + a one-time setup fee of $100/MLO.

Other staff such as assistants, processors, LOA's, etc, can be added as users at no additional cost, up to the maximum of 25 total users per account.

The 2,500 contacts limit is shared across all users in your account. Additional contacts are available for purchase.

If you have more than 5 MLO's who require their own pipelines, automations, etc, you'll need a new account for each set of 5 MLO's.

Sharing of Information

MLO Shift respects your information. We do not sell your information to outside businesses or 3rd parties. We do share your information with companies and contractors as needed to provide you with the products and services you have requested. These companies and contractors are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

MLO Pages Subscription Details

MLO Shift membership also includes one subscription to MLO Pages, a funnel and landing page service. This subscription includes unlimited Funnels, unlimited landing pages, unlimited visitors and unlimited leads.

Opt-In Only and Spam Prevention Policy

You Must Read And Agree Before Using MLO Shift and Included Systems.

Email, SMS & Slybroadcast Spamming

Our Policy:

You certify that you will not use MLO Shift, ActiveCampaign, Slybroadcast or any other service offered by us, integrated with our help, or otherwise associated or mentioned by us, to send unsolicited SMS messages, Slybroadcast voicemails, alerts, notifications, emails or any other unsolocited communications to anyone, unless they have specifically given you consent (opted-in) to receive them.

It is solely your responsibility to ensure that you are following the law and providing any legally required disclosures to your customers and prospects at the time the law requires them. Furthermore, it is your responsibility to ensure that anyone who unsubscribes via email or replies "Stop", "Unsubscribe" or any other message indicating they no longer want to receive text messages, is sufficiently unsubscribed in your system and they will not receive further communications from you. The responsibility and obligation to refrain from communicating with any person who does not want to hear from you rests on you alone. MLO Shift, LLC, its owners, directors, officers, employees, representatives, successors, and assigns, shall not be liable for blocking or for any failure to block messages to such phone numbers or email addresses.

Third Parties:

You certify that you will follow all 3rd party provider terms and conditions, regarding SPAM and all of their terms and conditions, in addition to our policy.

Our Definition of Spam:

We consider any unsolicited, unexpected, or unwanted message or communication to be Spam. We believe that any type of communication sent to a subscriber about an unrelated subject, which they did not request or consent to receive, to be Spam.

Client Agreement:

This Opt-In and Spam Prevention Policy is incorporated in and made a part of our Terms and Conditions Agreement (found at the following link: https://www.mloshift.com/pages/privacy-policy); Client agrees to be bound by both this Policy and our Terms and Conditions.

Responsible Parties:

It is Client’s responsibility to adhere to ALL state and federal laws, rules, and regulations regarding sending unsolicited bulk / group text messages, SlyBroadcasts / Dials, outbound calls, commercial solicitations, and/or delivering pre-recorded telephonic messages to homes, mobile numbers, or businesses without prior express consent, including, without limitation, the Federal Trade Commission’s Telemarketing Sales Rule, the Federal Communication Commission’s Telephone Consumer Protection Act Rule, and state and local telemarketing and consumer protection laws, as they may be enacted, amended, and/or updated from time to time. Under these laws and regulations, Client’s use of the services hereunder may be restricted. These restrictions can include, but are not limited to, placing “abandoned” calls; the frequency, days, and/or time of day in which your outbound calls can be placed; use of prerecorded or artificial telephone messages; use of auto-dialers to call cellular telephone numbers; use of Automatic, Power, or Predictive Dialers; and the display of caller ID information. Client agrees to provide persons that Client contacts with all disclosures required by law, including those required at the outset of a telemarketing call, prior to a consumer purchase or payment, or in conjunction with lead generation services offered by Client. A violation of any of these laws or regulations may result in significant penalties and other sanctions. BECAUSE TELEMARKETING AND SOLICITATION LAWS AND REGULATIONS ARE COMPLEX AND MAY CHANGE FROM TIME TO TIME, CLIENT IS STRONGLY ADVISED TO SEEK THE ADVICE OF AN ATTORNEY REGARDING OUTBOUND TELEMARKETING AND SOLICITATION CALLS AND MESSAGES AND/OR USE OF AUTOMATED TELEPHONIC EQUIPMENT PRIOR TO USING OUR SERVICES FOR TELEMARKETING OR SOLICITATION PURPOSES. In no event shall MLO Shift, LLC, or its owners, directors, officers, employees, representatives, successors, or assigns, be liable for Client’s failure to comply with all such applicable laws and regulations. Client will indemnify, defend, and hold MLO Shift, LLC, and its owners, directors, officers, employees, representatives, successors, and assigns harmless from and against any and all liabilities, claims, complaints, cost (including attorneys’ fees) and expenses arising out of Client’s failure to comply with these or any other applicable laws and regulations.

All Do Not Call (“DNC”) lists must be maintained in Client’s own internal database. If Client is advised by any customer or prospect that they do not wish to receive communications from Client or the services provided hereunder, then Client will promptly add those customers or prospects to Client’s company-specific DNC list and will ensure such list is integrated with any software used in connection with the services provided hereunder, and thereafter refrain from calling, texting, or otherwise communicating with such parties. If we determine, in our sole discretion, that the receipt of communications via the services provided by our system is not consensual, or violates any federal, state and/or local rule and regulation, or is harassing to consumers or businesses, we may suspend services until DNC Compliance is met or terminate Client’s services.

With regard to Client’s use of any system associated with MLO Shift, Client accepts sole responsibility for understanding and complying with any and all applicable laws and regulations concerning mortgage marketing, the collection, storage, retention, protection, use, disclosure, and dissemination of personal, protected, or private information of individuals, including, without limitation, general data protection laws, such as the General Data Protection Regulation (“GDPR”). This is not an exhaustive list of all potential applicable privacy laws and regulations and Client remains responsible for ensuring Client’s compliance with any and all applicable privacy laws and regulations. Client will indemnify, defend, and hold MLO Shift, LLC, its owners, directors, officers, employees, representatives, successors, and assigns, harmless from any and all liabilities, claims, complaints, cost (including attorneys’ fees) and expenses arising out of Client’s failure to comply with applicable privacy laws and regulations in connection with use of our system.
